Arbitration is a process for the settlement of disputes in which an independent and impartial arbitrator makes a decision after considering the representations of the parties. The arbitrator’s decision is called an award and is normally final and binding on the parties. The award is written and is enforceable by the courts.
Mediation is a voluntary process where parties revaluate issues to a dispute by the help of a mediator. A mediator acts as an independant and impartial third party who facilitates discussion where parties explore and, if appropriate, reach a mutual resolution of some or all of the issues in dispute. The mediator has no authority to make decisions regarding the outcome and has no power to impose settlement.
